  • 17.08.01 if the Consumer Customer has already requested a specific remedy, Sodini remains obliged to implement it, with the necessary consequences regarding the expiry of the 40 (forty) day term mentioned above, unless the Consumer Customer accepts the proposed alternative remedy;

  • 17.09.03 the defects are due (in whole or in part) to misuse or improper use, storage, maintenance or installation carried out by persons other than Sodini or to failure to comply with the instructions provided by the Seller or other instructions from Sodini;
  • 17.09.04 at the conclusion of the Contract, the Consumer Customer was aware of the defect and could not ignore it with ordinary diligence;
  • 17.09.05 the lack of conformity derives from instructions or materials provided by the Consumer Customer.

18.07. Sodini reserves the right to withhold the payment until it has received the Product subject to the right of withdrawal, or until the Consumer Customer has demonstrated that he has returned the Product.

18.08. The Consumer Customer is not entitled to a refund of the price paid if he or she has not exercised the right of withdrawal according to the methods, conditions, and terms established in the preceding provisions. In this case, the Consumer Customer may obtain, at his or her own expense, the same Product already returned to Sodini, in the same condition in which it was returned. Otherwise, Sodini may retain the returned Product, in addition to all sums already paid by the Consumer Customer for the purchase.
